MS will remain tight-lipped on XBL status thanks to lawsuit

Major Nelson, on his weekly podcast, has revealed exactly why nothing has been said for a while about the Xbox Live issues that remain. Thanks to the lawsuit filed in Texas, it means Microsoft can no longer update us on the situation due to legal issues.

The on-going issues have plagued the service since the Christmas period; at times Live will randomly sign you out for no apparent reason, or the dashboard will take well over a minute to load up fully. Other problems have prevented games such as Call of Duty 4 from working properly in matchmaking

Throughout the issues though, Major Nelson has been a top source for updates thanks to his Twitter page, where he initially told anyone who cared that the Live team were working on Live, and that Live was fixed, and that Live was broken again. Not an informative status update, but it was nice to see something nonetheless. Now though, such information cannot and will not be disclosed because they simply are not allowed to.

This is a major blow for the Xbox community as it was at least nice to know that the issues were known about and were trying to be dealt with. Now we wait with baited breath for it to be fixed, without ever being told officially. Thanks, you Texas tossers.

If Microsoft would get their damn act together and provide us with the service we paid for, they wouldn’t NEED to provide us updates. Don’t blame the Texans. They have every right to sue for the crappy service we’ve been receiving. Good for them. Maybe Microsoft will think twice next Christmas season before letting the service go to hell.

I hardly ever find the time to play online during the year, then during the xmas holidays I finally did and guess what… the service didn’t work. MS knows there are a lot of people like me who only use the service during holidays but obviously they didn’t provide enough servers/bandwith to cope with it.

This sucks, the only way to get online, is by signing in with a Game or DVD. I cant sign in on the dashboard at all once peak time hits, and I cant revert to it after signing in either.

1. xbox 360 “DRM” was created by the Devil
2. xboxlive will be up and running 100% whenever they fix it. They had no intention of updating us anyway.

This is odd, i’ve not had any problems at all so far (fingers crossed!!!) My isp is virgin so i have no idea if that could be a factor. Oh well free xbla game in it for me, although i’m not holding my breath for a good game :o)

Let’s face it, Microsoft are using an apparently minor nuisance lawsuit to conveniently hide behind here. “We can’t update you on Live’s staus because we’re being sued” would more honestly be phrased as “We don’t want to update you on Live’s status because it is royally fucked and this gives us bad press so we’ll just use this lawsuit as an excuse, ok?”

I can’t believe the xboxic crew are swallowing this Microsoft spin and blaming the texans for it. Where’s your credibility ffs? I was under the impression this site was run by independents and not a bunch of Microsft kiss-arses that simply regurgitate the bullshit from the company press machine. Am I wrong then? Have you been bought and paid?

Point One - Due to a small minority all customers are left in the dark about a service we all pay for. In any other business this would become a lawsuit in it own right, Doh!!

Point 2 - If and when M$ sort this problem out will they tell us or say nothing while this lawsuit goes through the motion i.e. a long time based of the US judicial system

Point 3 - What is the context of the lawsuit. Are these individuals doing this for their own benefit or for all users?

Finally this will help M$ as the pressure increases daily on what they really have to do to resolve this problem.

heres some more info under M$ terms & conditions

Please note that this contract limits our liability and we do not provide warranties for the Service.” That’s not particularly clear, however, so let’s dig a little deeper.

“Microsoft may, among other things: (a) restrict or limit access to the Service; … (c) upgrade, modify, withdraw, suspend, or discontinue any functionality or feature of the Service or any game from time to time without notice …” So, Microsoft clearly reserves a lot of rights for itself, should it ever want to change something. But this clause doesn’t account for the problems that Live has had recently, and –which I’m not lawyer, by any possible stretch – I would imagine it could be construed as fraudulent for Microsoft to fall back on this particular clause as an explanation for why they Live members aren’t entitled to any remuneration.

But then we reach clause #16 which takes the issue and just slaughters any argument to the contrary. (It was also at this point that I went insane.) The clause, in its entirety, reads:

16. WE MAKE NO WARRANTY
We provide the Service “as-is,” “with all faults” and “as available.”

The Microsoft Parties give no express warranties, guarantees or conditions. You may have additional consumer rights under your local laws that this contract cannot change. To the extent permitted by law, we exclude the implied warranties of merchantability, fitness for a particular purpose, workmanlike effort and non-infringement.

That’s truly the “game, set, match” item I knew I would find buried away somewhere in the Terms of Service. But why even offer a free Xbox Live Arcade game if it’s so unequivocally apparent that Microsoft doesn’t out you a dime?

You should quote more/differently. Microsoft explicitly states that some of their terms are void in certain regions/countries. Despite that; you’re unable to get reimbursement if the losses are less than the cost of getting reimbursed…

I for one, think we should support MS in this case. The stupid lawsuit gains no one, but the lawyers. They are a drain on society and there is no reprecussion for frivilous lawsuits. This raises cost for everyone and now we are also get limited updates on what the problem is. Anyone who runs a business understands that things happen every now and then, but should we get sued every time? Do I get upset that service is intermittent when I paid for it? Of course, but they have made every attempt at resolving the issue and will offer me (probably a crappy) arcade game. We should sign a petition to show to point out we do not want lawyers sucking out money!!!

At the end of the day it all stems from M$ ineptitude at customer support. We are all having some level of problems. A simple announcement and honestly is all it takes for the vast majority. The silence creates rumour and hysteria.
The system isn’t working; this is what’s its going to take to fix it and this is how long it will take. Simple.
One thing I’ve not heard mentioned is the problems caused by user broadband connections. A lot of these 360’s are sold to people who don’t know their router from a blender, believe me I know. So we get people with 2mb connections trying to host a game with user with 16mb + connections 5000 miles away. This must also effect downloads. I wonder how many systems are downloading at any give time.
I personally think it’s going to take a big server investment from M$ to sort this out and financial will the cost of membership be altered to provide Live in the future.

Balls.

At the end of the day MS and any other company will look at the investment they need to put into upgrading the service rather than just upgrade by some random amount based on a guesstimate.

They now know they have sold X amount of consoles, which will require an upgrade of X amount of server capicity.

It doesn’t make good business sense to do it the other way, and the increase in the amount of Live subscriptions should pay for the upgrade anyway rather than increasing the price of Live.

Think a little before spouting ballocks.

I was talking about an annoucement now (well before the lawsuit) based on them now knowing how many users there are.I was also making the point of the approach M$ maybe taking with Live and the investment in the current setup. Do they go with the Playstation Network approach with dedicated servers or stick with the p2p system.

i think its great what they did,ms needs to learn a lesson, we pay for there service,then it should be on point. they knew what was gonna happen and they didnt stop it, im glad someone took action even though we cant get any updates for awhile. you people should be applauding these people,ms is corporate america and they dont give a damn about how much we have problems in a game they just take are money and say “were workin on it” thats bull and you know it. if it was really a mistake on there part,they would have refunded or gave us a free month which is what should have been done,but they really dont care….wake up people
